1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Namuh, Inc. ("Company," "we," "us," or "our"), governing your access to and use of the Ever browser extension, website, API, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

Ever is an AI-powered browser automation platform that enables users to automate web workflows through a Chrome browser extension and associated cloud services. The Service uses artificial intelligence to interpret, plan, and execute web-based tasks on your behalf.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account Registration

To use certain features of the Service, you must create an account using Google OAuth authentication. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Automate actions on websites in violation of those websites' terms of service or robots.txt directives
• Engage in scraping, data harvesting, or unauthorized data collection
• Distribute malware, spam, or other harmful content
• Attempt to gain unauthorized access to systems, accounts, or data
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to conduct any activity that could harm, disable, or impair any website or service
• Reverse engineer, decompile, or disassemble any part of the Service

6. Intellectual Property

The Service, including its software, design, text, graphics, and other content, is owned by Namuh, Inc. and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain ownership of any data or content you provide through the Service.

7. Subscriptions and Billing

Certain features of the Service may require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, but no refunds will be issued for partial billing periods unless required by applicable law.

8. AI-Generated Actions

The Service uses artificial intelligence to automate web interactions. While we strive for accuracy and reliability, AI-generated actions may occasionally produce unexpected results. You acknowledge that you are solely responsible for reviewing and supervising actions performed by the Service on your behalf. We are not liable for any consequences arising from automated actions executed through the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAMUH, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Namuh, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the effective date at the top of these Terms and, where appropriate, providing additional notice (such as via email or through the Service). Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in Alameda County, California.
